Chronically Healthy Life (“Chronically Healthy Life,” “we,” “us,” or “our”) welcomes you. These Terms & Conditions (“Terms”) govern your access to and use of our websites and related pages we operate, including chronicallyhealthylife.com and any related domains, subdomains, or Kajabi pages (collectively, the “Websites”).
By accessing or using the Websites, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Websites.
If you create an account (“Registered User”) and/or purchase any product or service, you also agree to any purchase-specific terms presented at checkout (“Terms of Purchase”). If there is a conflict between these Terms and the Terms of Purchase, the Terms of Purchase control.
IMPORTANT NOTICE: The sections titled “Binding Arbitration” and “Class Action Waiver” affect your legal rights. Please read them carefully.
1) Description and Use of the Websites
We provide Visitors and Registered Users access to the Websites and related services, including educational content, programs, products, and community features (“Services”).

2) Who Can Use the Websites
The Websites are available to individuals 13 years or older. If you are under the age of majority in your jurisdiction, you may use the Websites only with the involvement and consent of a parent or legal guardian.
3) Community Guidelines
We want Chronically Healthy Life to be a respectful, helpful space. By using community features (comments, groups, posts, etc.), you agree to follow these rules:

Post content that infringes copyrights, trademarks, privacy/publicity rights, or other rights of others

Post content that is defamatory, obscene, pornographic, sexually explicit, hateful, harassing, violent, or threatening

Spam, solicit, advertise, or promote commercial activity without our written permission

Exception: Public search engines may index public pages solely to create searchable listings (not caches/archives).

Enforcement. We may remove content, restrict access, suspend accounts, or terminate access to the Websites at any time in our sole discretion, with or without notice.
Reporting. If you see content that violates these guidelines, please contact us so we can review it.
4) Account Security
If you create an account, you agree to provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
Notify us promptly if you suspect unauthorized access. We may reset credentials or suspend access to protect the Websites and our users.
5) Fees, Payments & Billing
Purchases. If you purchase a product or service through the Websites, you agree to pay all applicable fees and taxes at the prices shown at checkout.
Payment processing. Payments are processed through our third-party payment processors. By purchasing, you authorize us (and/or our payment processor) to charge your selected payment method for the total amount due, including applicable taxes.
Accurate billing info. You agree to provide current, complete, and accurate billing information and to keep it updated (including billing address, card number, and expiration date). If your payment method fails, you remain responsible for all amounts due.
Fees from your bank/card issuer. Your bank or card issuer may charge additional fees (including foreign transaction fees). Those fees are your responsibility.
Collections. If your account becomes past due, you agree to pay reasonable collection costs and fees, including attorney’s fees where permitted by law.
6) Intellectual Property
The Websites and all materials on them — including videos, programs, coursework, training modules, text, graphics, images, audio, and downloads (collectively, the “Content”) — are owned by Chronically Healthy Life or licensed to us and are protected by intellectual property laws.
Permitted use. You may access and view publicly available Content for your personal, non-commercial use. If you purchase a product or service, you may access and download the Content included in that purchase for your personal, non-commercial use only.
Prohibited use. Except as expressly allowed in writing by Chronically Healthy Life, you may not:

Copy, reproduce, distribute, sell, lease, sublicense, or transfer any Content

Publicly display, publicly perform, or create derivative works from any Content

Share login access or paid materials with others

Post our paid materials on any other website, platform, or shared drive
If you violate this section, your permission to use the Websites and Content ends immediately and you must delete/destroy any copies.
Trademarks. “Chronically Healthy Life” and our logos, names, and branding are our trademarks. You may not use them without our prior written permission.
7) User Content (Posts, Comments, Uploads)
Some parts of the Websites may allow you to post comments, messages, images, or other content (“User Content”). You are solely responsible for any User Content you submit.
No confidentiality. Anything you post may be visible to others. Do not post confidential or sensitive information.
Your rights. You keep ownership of your User Content.
License to us. By submitting User Content, you grant Chronically Healthy Life a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, host, store, reproduce, modify, publish, translate, distribute, display, and otherwise use your User Content as needed to operate, improve, and promote the Websites and our offerings.
Your promise. You represent and warrant that:

Your User Content does not violate laws, third-party rights, or these Terms
We may remove User Content or restrict access at any time in our sole discretion.
8) Communications You Send to Us
Do not send confidential information via email or public forms. If you send feedback, suggestions, or ideas, you agree we may use them without compensation or attribution.
9) No Medical Advice
All content on the Websites is provided for educational and informational purposes only. Nothing on the Websites should be considered medical advice, diagnosis, or treatment, and it is not intended to replace guidance from a licensed healthcare professional.
Chronically Healthy Life does not diagnose, treat, cure, or prevent any disease. Always consult your physician or qualified healthcare provider regarding any medical questions, symptoms, or before starting any new wellness routine.
If you think you may have a medical emergency, call 911 or seek immediate medical care.
10) Disclaimers & Limitation of Liability
No warranties. The Websites and all Content are provided “as is” and “as available.” To the fullest extent permitted by law, Chronically Healthy Life disclaims all warranties, express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, non-infringement, and title. We do not guarantee that the Websites will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Limitation of liability. To the fullest extent permitted by law, Chronically Healthy Life (and its owners, team members, contractors, and partners) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Websites or Content — even if we have been advised that such damages are possible.
Maximum liability. If Chronically Healthy Life is found liable for any claim, our total liability will not exceed the amount you paid us (if any) in the three (3) months immediately before the event giving rise to the claim.
Jurisdiction notes. Some states do not allow certain warranty disclaimers or limitations of liability. In those cases, the above provisions apply to the maximum extent permitted by applicable law.
Corrections and updates. We may update or correct Website content at any time without notice, including pricing, descriptions, and availability. We do not guarantee that all information on the Websites is complete, current, or error-free.
11) External Links
The Websites may contain links to third-party sites. We do not control and are not responsible for third-party content. Accessing external sites is at your own risk.
12) Indemnification
You agree to defend, indemnify, and hold harmless Chronically Healthy Life and its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:

13) Termination
We may restrict, suspend, or terminate your access to the Websites at any time for any reason, without notice or liability. 15) Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
16) Binding Arbitration
If a dispute arises out of or relates to these Terms, the Content, or the Websites (“Dispute”), either you or Chronically Healthy Life may choose to resolve the Dispute by binding arbitration under the Federal Arbitration Act (“FAA”), rather than in court.
If arbitration is chosen:

You and we waive the right to a jury trial and to have the Dispute decided by a judge, except where small claims court is permitted (see below).

Arbitration is generally more limited than court, including discovery and appeal rights.
Small Claims Exception:
Either party may bring an individual claim in a local small claims court if the claim qualifies and remains in that court.
Administrator & Rules:
Arbitration will be administered by JAMS under its applicable rules and procedures (including streamlined or expedited rules when appropriate).
Location & Format:
Arbitration may be conducted in person, by phone, online, by document submission, or a combination. If held in person, it will take place in the U.S. county where you reside (unless the parties agree otherwise).
Fees:
Each party will be responsible for arbitration fees and costs as determined by JAMS rules, unless applicable law requires otherwise.
Decision:
The arbitrator’s decision will be final and binding, with limited rights of review under the FAA. Judgment on the award may be entered in any court with jurisdiction.
17) Class Action Waiver
To the fullest extent permitted by law, you agree that any Dispute between you and Chronically Healthy Life will be brought only on an individual basis.
That means:

No class actions, collective actions, or representative actions

No combining your claim with another person’s claim

No acting as a private attorney general or representative for others
You may bring claims against us only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
18) Equitable Relief
You agree we may seek injunctive or equitable relief to protect our intellectual property and proprietary rights.
19) Miscellaneous

Our failure to enforce any part of these Terms is not a waiver.

These Terms are the entire agreement regarding your use of the Websites, unless a written agreement states otherwise.
